Electronic Records and Signatures Disclosure
Sand Star Services, LLC ("Sand Star", "we") uses this customer portal to give you documents about your project and to let you review, make selections on, and sign them electronically. Federal law (the Electronic Signatures in Global and National Commerce Act) and Texas law (the Texas Uniform Electronic Transactions Act) allow this when you agree to it and are told your rights first. This page is that notice. Please read it and keep a copy.
1. What you are agreeing to
By ticking the consent box on the signing page you agree that Sand Star may provide the following to you electronically through this portal and by email to the address we have on file, instead of on paper: Polaris360 Assessments, proposals, contracts, project change requests, monthly performance reports, customer invoices and payment information, certificates of completion, and notices about those documents. You also agree that you can sign those documents electronically here and that your electronic signature has the same effect as a signature in ink.
2. Paper copies
You may ask for a paper copy of any document at any time, at no charge. Call (409) 256-8334 or email info@SandStarServices.com and tell us which document you need. You can also print or save any document from the portal yourself.
3. Withdrawing your consent
You may withdraw this consent at any time by emailing info@SandStarServices.com or calling (409) 256-8334. Withdrawal takes effect once we have processed it, and from then on we will provide documents to you on paper or in person. Withdrawing does not undo any document you signed electronically before withdrawing, and it may slow down your project because documents will take longer to exchange.
4. What you need to use the portal
- A current version of a common web browser (for example Safari, Chrome, Edge or Firefox) with JavaScript and cookies enabled, on a computer, tablet or phone with an internet connection.
- An email account, at the address Sand Star has on file for you, where you can receive one-time sign-in codes and copies of what you sign.
- Software to open PDF files, which is built into every browser above.
- A printer, or enough storage on your device, if you want to keep your own copies.
If these requirements change in a way that could stop you from using the portal, we will tell you and ask for your consent again.
5. Keeping your email address current
Your email address is your portal username and where copies are sent. If it changes, call (409) 256-8334 or email info@SandStarServices.com so we can update your file.
6. How electronic signatures are recorded
To sign, you sign in with a one-time code sent to your email, open and review the document, type your full name, apply a signature you adopt (auto-generated from your name, drawn, or an uploaded image of your handwritten signature), and confirm a statement of agreement. The portal records your name, your email address, the date and time, the internet address and browser you used, the exact statement you accepted, the version of this disclosure you accepted, and a fingerprint (SHA-256 hash) of the exact file you reviewed. It then produces a signed copy of the document with your signature and selections applied, and a certificate of completion that lists all of this. Both are stored with your project in Sand Star's systems and stay available to you here after signing in. A copy is also emailed to you.
7. Declining to sign
You are never required to sign electronically. Every signing page has a "Decline to sign" option. Declining tells your Sand Star contact right away, keeps the document available to you for reference, and means that version can no longer be signed. You can also simply contact us to handle the document on paper.
8. Records and privacy
Signed documents, certificates and the signing record are kept for at least ten years after your project is completed. That period matches the ten-year statute of repose for construction claims under Texas law (Texas Civil Practice and Remedies Code section 16.009), so the record of what was agreed stays available to both of us for as long as a claim could arise. You can open your copies in the portal at any time during that period, and you can request a copy afterwards by contacting us.
